GENERAL TERMS AND CONDITIONS FOR E-COMMERCE  

General  

These terms and conditions ("Terms") apply between Helgabad Oy, 2622789-5 ("Company") and the customer who makes a purchase from Helgabad Oy via the www.helgabad.com ("Website"). Detailed contact information and other information about the Company can be found on the website. The terms apply only to consumers who carry out orders and buy a product from us via the website. 

In addition to the Terms and Conditions, the Company also applies a Privacy Policy. In this policy, you can read how we treat your personal information when you shop with us. 

You need to be over 16 years old and not under guardianship. If you are under 16, your guardian’s consent is required to order from us. 

We may change these Terms at any time, but the changes that you approved at the time of your purchase always apply to that purchase. All changes will be reflected in the most recently published version of the Terms and Conditions on the Site. Changes will come into effect from accepting the Terms, that is, when you make a new purchase. 

Agreement and order - shipping & return 

In order to make a purchase via the Website, you must accept the Terms. 

Upon receipt of the order, the Company will send an order confirmation to you as soon as possible by e-mail confirming the order. Purchase agreements are only concluded when the Company has confirmed the order in writing, and you have received the order confirmation by e-mail. 

We reserve the right to refuse an order, for example, if you have entered incorrect information or the order cannot be met due to products being out of stock. Please note that products that are temporarily out of stock must be re-ordered on another occasion. 

Shipping within Finland:  

Standard POSTI shipping within Finland starts at 7.90€, depending on the quantity of products that you order and free on orders over 250€.   

International shipping: 

Shipping is only available to countries within Europe. Should you wish you order from a country outside Europe please send an email to pia(at)helgabad.com. Orders outside Finland start at 19.90€ depending on the shipping destination and quantity of products that you order.  

For orders that have not been picked up, we have the right to charge a fee of 40€ for our handling cost of the order and for the return. 

Returns: You are free to return your product(s) within 14 days of the receipt of your product(s). Returns are paid by you.   

Delivery

Cost of shipping will be added upon order unless otherwise stated. More information about which delivery options we offer can be found on the Website. At the moment we do not ship outside Europe. If your country does not show as an option, please write to pia(at)helgabad.com and I will see what the options are. Please note that restrictions on the different options may occur. Delivery time may vary depending on the country of destination. The expected delivery time is shown on the Website and will be displayed to you during the ordering process. Unless otherwise agreed, delivery will be made no later than 30 days from the Company confirming the order in writing by order confirmation. Please note that delivery times are approximate and deviations from these may occur. If your order is delayed, you will receive a message about this. Before delivery, you will receive a notification indicating when and where your order will arrive. You are responsible for receiving or redeeming your order for the time specified in the notice. Packages are primarily collected personally with valid identification and order number. For orders that have not been picked up, we have the right to charge a fee of 40 EUR for our handling cost of the order and for the return. 

Product information etc. 

We reserve the right for final sale of products as well as any image or writing errors on the Site, in advertisements or other promotional material as well as product descriptions. The Company has the right to correct such errors, modify or update the information on the Site and to continuously make product changes and improvements on the Site. 

Images on the Website that show products, in advertisements and other promotional material should be considered for illustrative purposes only and not a specification of the product's features, functions, origin or as a warranty. The Company is not responsible for information on the Website that comes from a third party. 

The content of the Website is protected by copyright. Product names and logos may also be protected by trademark law or under market law. This means that trademarks, company names, product names, images and graphics, designs, layouts, and information about products, services and other content may not be copied or used without the prior written consent of the Company. 

Prices and payment 

When ordering, prices quoted on the Website are stated at the time of the order, unless otherwise agreed. All prices are quoted in EUR and include current VAT. Prices do not include any payment and shipping charges, which are listed separately. The total price of the order will be displayed before you complete the order and in the order confirmation. 

The company strives for the Website to contain the correct information as far as possible. However, we reserve the right that the site may contain typographical errors and incorrect prices and we are not responsible to change prices that you realized or should have realized were incorrect. If an incorrect price has been specified for an ordered product, we will notify you and wait for any approval of the corrected price before the order is considered approved. 

You can pay for your purchase by using any of the payment options available and according to the separate payment terms listed on the Website. We reserve the right to not always offer a particular payment method or change payment method if the selected payment method for some reason does not work at the time of purchase. 

Promotions, discount codes and other offers 

The Company may, from time to time, carry out promotions, discount codes and other offers for different products ("Offers"). For products covered by such Offers, the discount or the favorable terms apply for the limited period specified in connection with the Offer in question or as long as the stock is sufficient. Otherwise, these Terms and Conditions apply. 

Offers cannot be combined with other discounts unless explicitly stated otherwise. Upon termination or revocation of the Offer, these Terms and Conditions shall apply in full to the products previously included in the Offer. 

Right of withdrawal for individuals 

When you purchase products from the Site, you have the right to withdraw your order within 14 days without giving any reason, except as stated below. If you wish to use your right of withdrawal, you must notify us within 14 days of receipt of the ordered product ("Refusal Period"). When you make your purchase via the Site, you have the right to open the package and examine the product to the extent necessary to determine if you are satisfied with it. Please note that some products are not covered by the right of withdrawal. The right of withdrawal does not apply to the following types of products: goods that have been manufactured accordingly to your specifications; sealed goods that cannot be returned for health or hygiene reasons; a product that can quickly deteriorate or become too old. A product order where cancellation is not valid, you will receive clear information about this. If a product has been sealed, do not break the seal if you wish to exercise the right of withdrawal. The right to regret is thus terminated when you break the seal. Seal also refers to technical sealing (eg serial number). If you wish to use your right of withdrawal, you must send a clear message to the Company before the expiry of the expiration date. For smooth handling, the message should include your name, address, order number, order date, email address and what products you regret if the order contains several products. The notification can be sent via email. Products will be shipped to us without unnecessary delay and in any event, no later than 14 days after the date you notified us of your decision to withdraw from the agreement. When returning products covered by the right of withdrawal, you will pay the return charge and will be responsible for the returned product condition from receiving the product until we receive it. We recommend that the product is shipped in original packaging and well packed with tracking code. If you regret your purchase, we will refund all the payments we received from you related to this purchase. The refund will be made without delay and in any case no later than 14 days from the date of our notification of your decision to cancel your purchase. Refunds are made via the payment method you chose when ordering unless we have explicitly agreed otherwise. In any case, the refund will not cost you anything. We must wait for the refund until we have the returned item from you or until you submitted a proof that you returned the product, whichever occurs first.  
 

Warranty 

For the products covered by the warranty, the warranty period and other terms are stated for you to be able to guarantee the warranty of the respective product description on the Site. To be able to claim the warranty, the relevant proof of purchase, receipt and delivery note must accompany the complaint. 

Complaints for Individuals 

When ordering through the Site, you are always entitled to make a complaint within three years of the date you received the product. If you wish to make a complaint, contact the Company as soon as possible after the error has been discovered. For the complaint to be valid, it must always be done within a reasonable time after you notice or should have noticed the error. A complaint made within two months of the fault being detected is always considered to be made within a reasonable period. We recommend that you check the products when you receive them and that you report any damage to the packaging directly to the carrier or delivery point and record the damage to the freight handling. You can make a complaint to an incorrect product by returning it to us at the address listed on the Website. You are responsible for the condition of the returned product from receiving the product until the Company receives it. We therefore recommend that the product is shipped in original packaging and well packaged with tracking number. Once the Company has received the product and found that the complaint is valid, we will replace you in accordance with applicable law. This means that the error will be fixed or that we will replace the wrong product with a new one. If this is not possible or if the Company otherwise considers it more cost effective, the Company may instead repay the amount you paid for your order including the return cost. Please note that the Company is entitled to refuse a complaint if it is found that the product is not incorrect in accordance with applicable law and, in such case, the Company does not repay any expenses for return shipping.
